Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the KontactFlow platform (“Service”) operated by KontactFlow (“we,” “us,” or “our”). By creating an account, you agree to these Terms.

1. The service

KontactFlow is a software platform that provides an AI-powered chat widget for local service business websites. The widget answers visitor questions, qualifies leads, and captures contact information. The AI assistant is trained on information you provide about your business.

Important limitations: The AI assistant does not provide medical, legal, tax, financial, or diagnostic advice. Results are not guaranteed. Revenue estimates shown in the audit tool are based on industry averages and are not a guarantee of actual results.

2. Account responsibilities

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account. You may not share your account with others or use the service for purposes other than your own business.

You are responsible for the content you upload to train your AI assistant. You must not upload content that infringes on third-party rights, contains false or misleading information, or violates applicable law.

3. Acceptable use

You may not use the Service to engage in deceptive practices, impersonate others, collect personal information without appropriate consent, violate any applicable law, attempt to reverse engineer or copy the Service, or interfere with the integrity or performance of the Service.

4. Healthcare businesses

For businesses in healthcare verticals (medical, dental, chiropractic, mental health, and related fields), the Service includes mandatory compliance guardrails that prevent the AI from providing medical advice, diagnoses, or guarantees. These guardrails cannot be disabled. It is your responsibility to ensure your use of the Service complies with applicable regulations.

5. Payments and subscriptions

KontactFlow is offered as a monthly or annual subscription. Payments are processed by Stripe.

Monthly plans renew automatically each month. You may cancel at any time and your access continues until the end of the paid period.

Annual plans are billed once per year and are non-refundable. You may cancel renewal at any time to prevent the next annual charge.

Free trial — the 14-day free trial requires no credit card. You will be asked for payment information before your trial ends if you choose to continue.

Founding Rate — accounts that sign up at the Founding Rate ($97/month) keep that price locked for their first 12 months, provided the account remains active and in good standing. After 12 months, the account moves to then-current Standard pricing.

6. Termination

We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with 30 days' notice. Upon termination, your data will be retained for 30 days and then permanently deleted.

7. Intellectual property

The KontactFlow platform is owned by KontactFlow and protected by applicable intellectual property law. You retain ownership of the business information you upload. You grant us a license to use that content solely to provide the Service to you.

8. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE ANY PARTICULAR OUTCOME FOR YOUR BUSINESS.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Changes to these terms

We may update these Terms from time to time. We will notify active account holders of material changes by email at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the United States. Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules.
